Решая поставленные задачи, авторы раскрывают понятие и содержание права на жизнь в естественной среде, выявляют субъектов и объектов данного права, затрагивают ключевые аспекты публично-правового механизма обеспечения экологической и биологической безопасности как гарантии реализации рассматриваемого права. Приводится успешная практика правового регулирования и судебной защиты права на жизнь в естественной среде в зарубежных государствах, в том числе основанная на принципах равенства поколений и межпоколенческой справедливости, которая в настоящее время нуждается в распространении. Объектом исследования являются конституционно-правовые отношения, связанные с регулированием и реализацией права человека на жизнь в естественной среде; цель состоит в изучении новейших практик государственной политики в области обеспечения биологической и экологической безопасности, выявлении современных механизмов противодействия экологическим и биологическим вызовам и угрозам. Методологию исследования составили методы формальной логики, сравнительно-правовой, диалектический и системно-структурный методы. В результате исследования авторы приходят к выводу о необходимости выстраивания эффективной национальной государственной политики по правовой защите естественной среды жизни во взаимосвязи с обеспечением экологической и биологической безопасности. Достижение этой цели подразумевает определение понятия и содержания права человека на жизнь в естественной среде, формирование публично-правовых механизмов законодательного регулирования и судебной защиты данного права. </p></abstract><trans-abstract xml:lang="en"><p>The article examines fundamental issues related to the characterization of the human right to life in the natural environment in connection with institutions of environmental and biological security. In addressing the stated objectives, the authors explore the concept and content of the right to life in the natural environment, identify the subjects and objects of this right, and touch upon key aspects of the public-law mechanism for ensuring environmental and biological security as a guarantee of the realization of this right. The article presents successful examples of legal regulation and judicial protection of the right to life in the natural environment in foreign countries, including practices based on the principles of generational equality and intergenerational justice, which currently require broader dissemination. The object of the research is constitutional legal relations concerning the regulation and realization of the human right to life in the natural environment. The purpose is to study recent state policy practices in the field of environmental and biological security, and to identify modern mechanisms for countering environmental and biological challenges and threats. The research methodology includes methods of formal logic, comparative legal analysis, as well as dialectical and systemic-structural approaches. As a result of the study, the authors conclude that it is necessary to develop an effective national policy for the legal protection of the natural environment as a living space, in conjunction with measures to ensure environmental and biological security.
